Waiver Statement
I affirm and state that I am physically fit and sufficiently trained for participating in the designated race. I have been certified to be physically fit by licensed medical practitioner and agree to indemnify the organizers its agents, employees and associates, the organizing committee and other persons connected to the event against any losses, damages, costs, liabilities, claims or proceedings arising out of any misstatement and/ or misrepresentation made herein.
Terms & Conditions
- Third-Party Vendor Indemnity: The Participant acknowledges that PFS may engage third-party vendors for services such as timing chips, hydration, food, and security. The Participant agrees that PFS shall not be held liable for any acts, omissions, or negligence of these independent contractors. Any grievances regarding third-party services must be directed to the respective service provider.
- Intellectual Property and Branding: All event names, logos, slogans, and digital assets associated with the marathon are the exclusive property of PFS. The Participant is prohibited from using these for any commercial purpose, including the creation of "unofficial" merchandise or promotional material, without express written consent.
- Accuracy of Information and "Ghost" Runners: The Participant warrants that all information provided during registration (Age, Medical History, Emergency Contact) is 100% accurate. Providing false information or "selling/giving" a bib to another person ("Ghost Running") nullifies all insurance coverages and subjects both parties to a lifetime ban from events organized by PFS, with no liability on the Organizer for any mishaps occurring to the unauthorized runner.
- Course "As-Is" and Environmental Hazards: The Participant acknowledges that the marathon takes place on public roads and terrains. PFS does not warrant that the race course is free of defects, potholes, uneven surfaces, or environmental hazards (stray animals, pollution, or smog). The Participant accepts the course in its "as-is" condition at the time of the event.
- Finality of Arbitration: In the event of any dispute or claim arising out of or relating to these Terms and Conditions, the parties shall first attempt to resolve the matter through amicable negotiation. If unresolved, the dispute shall be referred to a sole arbitrator appointed by PFS, and the seat of arbitration shall be the seat of the Organizer’s headquarters. The Participant waives any right to seek a trial by jury or a class action lawsuit.
Sponsor & Financial Protection Clauses
- Sponsor Indemnity and Non-Liability: The Participant acknowledges that sponsors are financial supporters and/or prize contributors only and have no operational control over the event. The Participant hereby releases and forever discharges all event sponsors, their directors, officers, and employees from any and all claims, damages, or liabilities arising from participation in the event or its cancellation.
- Changes in Sponsorship: PFS reserves the right to add, remove, or substitute sponsors at any time without notice. The withdrawal of any specific sponsor or promised "goodie bag" item provided by a sponsor does not entitle the Participant to a refund or compensation.
- Sponsor-Provided Goods and Services: Any products, samples, or services distributed by sponsors (e.g., energy drinks, supplements, apparel) are accepted by the Participant at their own risk. PFS makes no warranties regarding the merchantability or fitness for a particular purpose of sponsor-provided items and is not liable for any allergic reactions or adverse effects.
- No Agency Relationship: The Participant agrees that no agency, partnership, or joint venture exists between PFS and the sponsors. The sponsors shall not be held vicariously liable for any actions, negligence, or contractual breaches committed by the Organizer or his staff.
- Promotional Rights for Sponsors: The Participant consents to the use of their name, image, and race results by event sponsors for post-event marketing and promotional purposes across all media platforms in perpetuity, without any financial compensation or prior approval rights.
